Default State Waiver Question

If there are any of you out there the work with State Waiver Programs I wanted to see if you run into this situation and have an answer.
If they require you to get a denial from Medicare on something when sending them a bid how do you handle this? You can't bill Medicare and get a denial unless you acutally deliver the equipment and get paper work and if it is an item that doesn't even have a code to bill there isn't a way to get the denial due to that reason. I keep telling them that you can't just bill to get a denial it is fraud and I don't but wasn't sure if there was some way that others are handling these situations?

I provide the LCD's. The agencies I work with have been ok with this - they
just need something to prove the patient doesn't qualify thru their
insurance and like you, I've explained that I can't bill for a denial.
