I'm told our Homecare Nursing Staff is "not allowed" to sign for the deliveries our own drivers make.

Is this accurate / really a conflict of interest? Where could I find supporting docmentation either way?

Anyone can sign for the physical delivery of the equipment. However, the AOB (Assignment of Benefits), ABN (Advanced Beneficiary Notices), Privacy Notices (HIPPA) can only be signed by the patient, a family member, power of attorney.

That means if the nurse is signing for the physical delivery, you would still need to get an eligible responsible party to sign the AOB,ABN,HIPPA.

I finally found the Ohio Law on this one:

5101:3-10-05 Reimbursement for covered services.

"...(a) Providers, their employees, or anyone else having a financial interest in the delivery of DME items are prohibited from signing and accepting an item on behalf of a consumer..."

The requirements obviously vary state to state.
